At North American Mutual, we take your privacy and financial security seriously. As part of our commitment to transparency and compliance with federal regulations, this page outlines our practices and responsibilities under the Fair Credit Reporting Act (FCRA).

Use of Consumer Reports

In connection with your application for insurance coverage, and in servicing your account, we may request and obtain consumer reports or investigative consumer reports from a consumer reporting agency. These reports may include: Credit history, Insurance claim history (CLUE reports) Driving record (MVRs). 

Other data related to personal or financial background. These reports are used solely to help our agency and our carrier partners determine your eligibility, pricing, and underwriting risk for the insurance products we help you shop for.

Your Rights Under the FCRA

As a consumer, you are entitled to certain rights under the Fair Credit Reporting Act, including: The right to know if information in your credit file has been used against you. The right to request a copy of your credit report from the consumer reporting agency. The right to dispute inaccurate or incomplete information. The right to opt-out of prescreened offers of credit and insurance.

Consent and Authorization

By submitting an application or quote request through North American Mutual, you provide express consent to obtain and use consumer report data for insurance underwriting purposes, in accordance with the FCRA.

If a consumer report is used in a way that results in an adverse action (such as denial of coverage or higher premium), you will be notified as required by law, and provided with information on how to obtain a free copy of your report and how to dispute any inaccuracies.

Confidentiality and Security

We do not share your consumer report information with third parties except as permitted by law and required for the purpose of placing your insurance with a carrier. We work with over 120 top-rated insurance providers and ensure all data transfers are secure and FCRA-compliant.

California Privacy & Fair Credit Reporting Act (FCRA) Compliance

At North American Mutual, we believe in protecting your privacy and respecting your rights as a California consumer. While we work with over 120 insurance carriers to offer Health, Life, and Property & Casualty Insurance, we are committed to full compliance with both federal and California-specific privacy laws.

This disclosure explains how your information may be used, your rights under the California Consumer Privacy Act (CCPA), the Fair Credit Reporting Act (FCRA), and the California Insurance Code.

No Credit Scoring for Insurance in California

Under California law, we do not use your credit history or credit score to rate or underwrite personal insurance policies such as auto, homeowners, or renters insurance. This is in accordance with:

California Insurance Code §791.12
California Code of Regulations Title 10, §2360.0 et seq.

Even though the federal FCRA permits insurers to use credit-based insurance scores in other states, California strictly prohibits this practice for personal insurance products.

What Information May Be Collected

In California, while we do not access or use credit reports, we may collect and use certain consumer information when required for underwriting or servicing your policy. This may include:

Motor Vehicle Reports (MVRs)
Claims History Reports (e.g., CLUE Reports)
Medical Information (with your consent)
Public Records or Regulatory Data

This data is collected only for lawful insurance purposes and not sold, shared, or used for any other reason.

Your Rights as a California Consumer

Under the California Consumer Privacy Act (CCPA), you have the right to:

Know what personal data we collect and how we use it
Request access to your data
Request deletion of your personal information
Opt-out of the sale of your personal data
Not be discriminated against for exercising your privacy rights

Disclosure Under California Insurance Code §791.06

In compliance with California Insurance Code §791.06:

You may request access to personal information collected about you in connection with an insurance transaction
You may request corrections to that information
You may receive a more detailed notice if investigative consumer reports are used
Any information collected may be shared with carriers only as allowed under California law

We will notify you if we take any adverse action (such as denial of coverage) based on any report used during the underwriting process.

We do not collect or store any unnecessary personal data. We do not sell consumer information. All data is handled securely and in compliance with both California and federal law.
